When you purchase tickets, access ticketing services, or attend Blerd Bash events through any platform, you accept and agree to, without limitation or qualification, the terms and conditions (the "Terms") set forth below.

Ticket availability for events may vary based on several factors, including but not limited to the following:

Initial Ticket Quantity

The initial quantity of tickets available for each event may be subject to change, either by increasing the number of available tickets or decreasing it based on factors such as venue capacity, demand, or other considerations.

Reserved Tickets

In some cases, a portion of the tickets may be reserved for special guests, sponsors, or other stakeholders, which could affect the number of tickets available for general purchase.

Tiered Pricing

The Company may implement tiered pricing strategies, where ticket prices may increase as the event date approaches or as the remaining number of tickets available decreases. It is advisable to purchase tickets early to take advantage of lower pricing tiers.

Ticket Packages

The Company offers various ticket packages, each with its own set of inclusions, access, and pricing. Availability for specific ticket packages may vary, with some packages selling out while others remain available.

Sold-Out Tickets

If a specific ticket type or package becomes sold out, it may no longer be available for purchase. Please review the available ticket options to find the most suitable option for your needs.

Pricing Changes

Ticket prices for certain types or packages may change over time based on availability and event dynamics. Prices may also vary based on the specific event, so it's important to check the pricing details when purchasing tickets.

Tickets may be purchased through authorized ticketing platforms and payment methods accepted by the respective platform. Payments made via unauthorized or fraudulent means will result in the cancellation of tickets without refund.

Refunds are available according to the following terms:

Event Cancellation: In the event of an event cancellation, ticket holders will be entitled to a full refund of the ticket price.

Event Postponement: If an event is postponed to a later date, tickets will be valid for the rescheduled date. If you are unable to attend the rescheduled date, you may be eligible for a refund as specified by event organizers.

Change of Venue: If an event venue changes, ticket holders will be informed of the new location, and tickets will remain valid. Refunds will be provided only if the new venue is infeasible for the event.

Other Refund Requests: All other refund requests, including those due to personal reasons or schedule conflicts, will be evaluated on a case-by-case basis, and refunds may be issued at the discretion of the Company.

To request a refund, ticket holders must follow the instructions provided by the authorized ticketing platform or contact the Company directly at support@blerdbash.com. Refund processing times may vary.

No refunds will be issued for ticket holders who do not attend the event (no-shows) unless otherwise specified by the Company.

Ticket exchanges for one event to another may be allowed at the discretion of event organizers. If exchanges are permitted, ticket holders must follow the instructions provided by the authorized ticketing platform or contact event organizers for details.

Tickets are transferable to another individual provided the following conditions are met:

• The ticket transfer adheres to the rules and guidelines set by the authorized ticketing platform.
• The Company is informed of the ticket transfer to maintain accurate attendee information.

The resale of tickets at a price higher than the face value, or through unauthorized resale platforms, is strictly prohibited. Violators may have their tickets canceled without refund.

For events that offer will call ticket pickup, ticket holders must present a valid government-issued photo ID and the credit card used for the ticket purchase to claim their tickets. Will call instructions and locations will be provided by the Company.

Third-party individuals picking up tickets on behalf of ticket holders must provide a signed authorization letter from the ticket holder, a copy of the ticket holder's ID, and their own government-issued photo ID for verification.

All attendees must adhere to the event's entry requirements, which may include age restrictions, security checks, and compliance with event policies, such as the Cosplay and Costume Policy and Code of Conduct.

The Company may add to, change, or remove any part of these Terms at any time, without notice. Any changes to these Terms or any terms posted on the Website or authorized ticketing platforms apply as soon as they are posted. Please note that modifications to these Terms do not constitute a valid reason for requesting a refund for an event. By purchasing tickets, you acknowledge and agree to comply with the Terms in its current form at the time of your ticket purchase and event attendance.

The Company may terminate or suspend ticket holder access to a specific event or future events in accordance with these Terms, the Code of Conduct, and event-specific policies. Termination may occur for various reasons, including, but not limited to, violations of the Terms, disruptive behavior, or breaches of event policies.

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, THE NEGLIGENCE OF THE COMPANY, ITS AGENTS OR SERVICE PROVIDERS, SHALL THE COMPANY, ITS AGENTS OR SERVICE PROVIDERS BE LIABLE FOR ANY CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, OR SPECIAL DAMAGES THAT RESULT FROM (A) THE USE OF OR THE INABILITY TO USE THE WEBSITE OR AUTHORIZED TICKETING PLATFORMS, (B) ATTENDANCE OF ANY EVENT HOSTED BY THE COMPANY (C) ERRORS OR OMISSIONS IN THE CONTENTS AND FUNCTIONS OF, THE WEBSITE OR AUTHORIZED TICKETING PLATFORMS, EVEN IF THE COMPANY OR ANY OF ITS AGENTS OR SERVICE PROVIDERS HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL THE TOTAL LIABILITY OF THE COMPANY, ITS AGENT OR SERVICE PROVIDERS TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR OTHERWISE) EXCEED $100.00.

These Terms and any additional terms posted on the Website together constitute the entire agreement between the Company and you with respect to your purchase and use of tickets and attendance to our events. The Company’s failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these Terms. The Company may assign its rights and duties under these Terms to any party at any time without notice to you.

Any alleged claim or cause of action you may have with respect to your purchase or use of a ticket or attendance of an event hosted by the Company must be commenced within one (1) year after the alleged claim or cause of action arises. You hereby waive your right to a jury trial in any such action. If, for any reason, a court of competent jurisdiction finds any provision of these Terms, or any portion thereof, to be unenforceable, that provision or portion shall be deemed severable, and shall not affect the validity and enforceability of any remaining provision of these Terms. These Terms shall be governed by and construed in accordance with the laws of the State of Texas without reference to its conflicts of law rules. Furthermore, you agree and consent to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in Tarrant County, Texas.
